Section 144 of the Penal Law provides that anyone who manufactures, imports, exports, or trades in weapons without lawful authorization is liable to up to 15 years' imprisonment.
The most serious offense among weapons offenses
Section 144 of the Penal Law provides that anyone who manufactures, imports, exports, or trades in weapons without lawful authorization is liable to up to 15 years' imprisonment. This is the top of the hierarchy: above possession (7 years) and carrying (10 years). The legislature and the courts see arms dealers as the engine of violence in Israel: every pistol sold on the black market is the next shooting in a conflict, in a neighborhood, or in the next murder, and sentencing policy is correspondingly severe, with legislative emphasis in recent years on harsher actual punishment.
What is considered "trading"?
The interpretation is broad: not only an actual sale, but also brokering between a seller and a buyer, possession of a weapon intended for sale, and participation in a supply-chain cell, from border smuggling, through storage, to delivery. Even someone who “only possessed” or “only transferred” for others may find himself accused of the offense of trafficking, based on correspondence, money, and surveillance. Trafficking cases are usually built through prolonged covert investigations: wiretaps, undercover agents, and controlled transactions.
Defense points in trafficking cases
Classification of the offense: the gap between possession and trafficking is many years of imprisonment, and attacking the “trafficking” evidence (for whom was the weapon intended? was a transaction proven?) is the central battle; legality of the investigative measures: wiretaps and agents are subject to strict rules, and their violation disqualifies evidence; a claim of defense from justice in transactions initiated by an entrapment agent; and identification: the connection between the defendant and the correspondence and aliases. In these cases, which open with detention until the end of proceedings, the defense must be built from day one.
Legal representation in weapons trafficking cases
Israel Arama, a former member of the Tel Aviv District Attorney’s Office, represents suspects and defendants in the most serious weapons offenses, and knows from the inside how trafficking cases are built on intelligence evidence and wiretaps. Contact him for urgent representation immediately upon arrest.
