Tama 38, transitional provisions, and replacement plans: examining the route for the property and the agreement with the developer.
What is Tama 38 and what do the residents receive?
Tama 38 is intended to strengthen buildings against earthquakes through building rights, through reinforcement and addition tracks or demolition and reconstruction. Today, it should not be assumed to be an open route for every building: its validity and transitional provisions have been affected by decisions of the National Planning Council, and there are local plans and alternatives under Amendment 139 to the Planning and Building Law. For every property, the applicable plan, the dates of the application and permit, and the decisions of the local committee must be examined. Added area, a safe room, a balcony, or a new apartment depend on the planning possibilities and the agreement; there is no uniform package of consideration guaranteed to every apartment owner. This is a real estate transaction in which rights of value are sold.
The critical points in the agreement with the developer
Guarantees: Sale Law guarantees for the new apartments, a rental guarantee for the construction period, a tax guarantee, and a defects guarantee; timelines with teeth: permit, commencement, and completion dates, and agreed compensation for delays, including an exit mechanism from the transaction if the developer does not advance; a binding specification and not a “developer standard”; the identity and strength of the developer: experience, previous projects, and accompanying bank financing; and a prohibition on assigning the project to another developer without consent. It is customary for the developer to bear the legal fees of the lawyer chosen by the apartment owners, within the framework of the transaction agreements. The lawyer represents the apartment owners and owes them loyalty, even when payment comes from the developer.
When the project becomes complicated
Developers who collapse midway, delays lasting years, deviations from the specification, and construction defects: residents have tools at their disposal, from calling the guarantees, through enforcement and compensation claims, to cancellation of the agreement and replacement of the developer. The key: an agreement built properly in advance, with exit points and real guarantees.
