The summary procedure has been abolished for new claims: how to distinguish between fast-track proceedings, a regular claim, and execution proceedings.
Summary procedure: the old track and the alternatives today
The summary procedure that was established in the old regulations is not a track for filing a new civil claim under the Civil Procedure Regulations applicable from 1 January 2021. In the past, certain claims for a fixed amount supported by a written document could be filed under it, and the defendant was required to seek leave to defend. Today, a distinction must be made between a claim in court, on the regular track or in fast-track proceedings according to its conditions, and designated proceedings in the Enforcement and Collection Authority, such as execution of a promissory note or a claim for a fixed amount. A signed contract does not in itself negate the defendant's right to defend in a regular claim.
Choosing the track according to the debt and the documents
Choosing the track begins with examining the source of the debt, its amount, and the evidence: agreement, orders, invoices, delivery confirmations, guarantee, or check. A claim for a fixed amount in the Enforcement and Collection Authority is subject to a ceiling, written evidence, and the warning and service requirements established by law; execution of a promissory note is subject to its designated rules. When the conditions are not met, an appropriate claim must be filed in court. Organized documentation supports proof of the debt, but does not guarantee a judgment or a fixed duration of proceedings.
Receiving a claim or warning: what to check
It is necessary to identify which document was received and from which authority: statement of claim, warning for execution of a promissory note, or warning in a claim for a fixed amount. The manner of response and the deadline are determined according to the proceeding and the service. Arguments of payment, setoff, forgery, or failure of consideration require detail and support in documents, and in appropriate cases also an affidavit. One should not assume that negotiations stop the deadline for filing a statement of defense or an objection. In an old case, the transitional provisions and the court's decisions should also be checked.
Legal representation
Israel Arama handles debt claims and defenses against them in court and in the Enforcement and Collection Authority, according to the appropriate track. Upon receipt of a claim or warning, it is important to check the response deadline and the documents required for the defense.
