Section 214 of the Penal Law prohibits the publication and display of obscene materials, and establishes a sharp scale of punishment: publication of “ordinary” obscene material, up to 3 years of imprisonment; publication of obscene material featuring the image of a minor, up to 5 years of imprisonment; use of a minor’s body for such publication, up to 7.
The legal framework
Section 214 of the Penal Law prohibits the publication and display of obscene materials, and establishes a sharp scale of punishment: publication of “ordinary” obscene material, up to 3 years of imprisonment; publication of obscene material featuring the image of a minor, up to 5 years of imprisonment; use of a minor’s body for such publication, up to 7 years of imprisonment; and possession or consumption of obscene material featuring the image of a minor, up to one year of imprisonment. The definitions are broad and also include simulated figures and computer-generated images that appear to be minors.
How Are These Investigations Opened?
Most cases are opened through international reports: technology platforms report suspicious content to designated bodies, and the information reaches the cyber units in Israel. The arrival of the police, usually in the morning with a search warrant, seizure of computers and phones, and arrest, takes the suspect completely by surprise. Many of those investigated are entirely normative people whose lives collapse in an instant.
Lines of defense
The mental element is the heart of the defense: possession requires awareness. Files that arrived without knowledge, automatic downloads, files in shared folders, use of the computer by others, and malware are all arguments examined on their merits through computer experts. The question of the legality of the search and seizure is also subject to examination. The suspect’s version in the first interrogation decides these cases: it must not be given without advice.
