Release on Bail – How It Works and What Determines the Conditions
Release on bail allows a person to continue their life while proceedings are ongoing, subject to an undertaking to comply with conditions.
Release on bail allows a person to continue their life while proceedings are ongoing, subject to an undertaking to comply with conditions. The amount and type of bail are not arbitrary; they derive from the grounds on which detention was considered.
Types of bail and security
- Personal bond — A financial undertaking by the suspect or defendant.
- Third-party guarantee — An undertaking by another person who assumes responsibility for compliance with the conditions.
- Cash deposit — A sum actually deposited with the court.
- Additional safeguards — Surrender of a passport, a prohibition on contact, or restrictions on where the person may stay.
What affects the amount of bail
The seriousness of the offense, the strength of the alleged concern, the suspect's history, and their financial means. The court should not set bail beyond a person's ability to pay, because that would effectively mean detention.
The principle: detention is the last resort
The Arrest Law states explicitly: a person shall not be detained if the purpose of the detention can be achieved in a way that causes less harm to his liberty. This is the legal foundation for the entire system of detention alternatives, and it is the defense's main working tool in detention proceedings: not only to argue about the existence of the ground itself, but to propose a response that neutralizes it.
Types of alternatives
Full house arrest under supervisors' oversight; partial house arrest with leave windows for work or defined needs; electronic monitoring (tagging); removal from the city, from the complainant, or from a certain area; prohibition on contacting those involved; deposit of a passport and a prohibition on leaving the country; and financial guarantees: self-bail, third-party bail, and a cash deposit. The right combination is tailored to each case according to the ground for detention: dangerousness is addressed through removal and supervision, concern about obstruction through a no-contact order, and concern about absconding through guarantees and a passport.
Violation and guarantees
Violation of release conditions leads to forfeiture of guarantees, renewed detention, and a charge of violating a lawful order. Any need to change conditions must go through a formal request to the court.
