Detention Until the End of Proceedings – How to Fight the Motion
When an indictment is filed, the prosecution may request that the defendant remain detained until the end of the trial.
What is detention until the end of proceedings?
Upon the filing of an indictment, the prosecution may request that the defendant be detained until the end of his trial. Such detention may last many months (generally up to 9 months, with possible extensions subject to Supreme Court approval), and it means that a person who has not been convicted of anything sits behind bars while conducting his defense. This is the proceeding in which the fight is for freedom while you are presumed innocent.
The Three Conditions for Detention
Section 21 of the Arrest Law requires the prosecution to prove: prima facie evidence to establish guilt, at this stage the investigative material is examined, and a defense attorney who identifies weaknesses in it can collapse the entire motion; grounds for detention: dangerousness, concern about obstruction or absconding, when in certain offenses (serious violence, weapons, drugs, domestic violence) a presumption of dangerousness arises; and the absence of an alternative: the court must examine whether the purpose of the detention can be achieved in a less harmful way.
Alternative to Detention: The Central Struggle
In most cases, the real struggle is over the alternative: full or partial house arrest, electronic monitoring, guarantees, distancing from places and people. The court usually refers the matter for a detention assessment by the Probation Service, which examines the defendant and the proposed supervisors. Proper preparation of the supervisory framework, suitable family members, financial guarantees, and an alternative place of residence is what determines the recommendation. A weak proposed alternative that is rejected stains the entire proceeding; a well-prepared alternative secures release.
