Alternatives to Detention – How to Build One the Court Will Approve
The Arrests Law expressly provides that a person must not be detained if the purpose of detention can be achieved by a means that infringes less on their liberty.
The principle: detention is the last resort
The Arrest Law states explicitly: a person shall not be detained if the purpose of the detention can be achieved in a way that causes less harm to his liberty. This is the legal foundation for the entire system of detention alternatives, and it is the defense's main working tool in detention proceedings: not only to argue about the existence of the ground itself, but to propose a response that neutralizes it.
Types of alternatives
Full house arrest under supervisors' oversight; partial house arrest with leave windows for work or defined needs; electronic monitoring (tagging); removal from the city, from the complainant, or from a certain area; prohibition on contacting those involved; deposit of a passport and a prohibition on leaving the country; and financial guarantees: self-bail, third-party bail, and a cash deposit. The right combination is tailored to each case according to the ground for detention: dangerousness is addressed through removal and supervision, concern about obstruction through a no-contact order, and concern about absconding through guarantees and a passport.
The supervisors: the heart of the alternative
The court does not release to an alternative without supervisors it trusts: family members or relatives with no criminal record, who understand their duty and are capable of providing continuous supervision. The supervisors are examined on the witness stand, and a supervisor who fails in examination brings down the entire alternative. Preparing the supervisors, choosing them correctly, and briefing them fully is defense work in every respect.
Violation and guarantees
Violation of release conditions leads to forfeiture of guarantees, renewed detention, and a charge of violating a lawful order. Any need to change conditions must go through a formal request to the court.
